1. Introduction - What We Do

We are FOMO7, an online gaming platform that offers an opportunity to participate in online casino, lottery, slot, and sports betting events. Any person using, accessing, and/or participating in any events on our platform is a User. All references to “You/Your” relate to the User. All “We/Us/Our” references relate to “FOMO7”. It also denotes a collective reference to the FOMO7 mobile application and the FOMO7 website (collectively called Platform).

2. Acceptance of Our Terms and Conditions

You should carefully review all terms and conditions. They contain important information concerning your rights and obligations while using our website and mobile application. By accessing our website or the mobile Application, you agree to be bound by these terms and conditions. You should refrain from accessing our website and mobile application if you do not accept these terms and conditions.

3. Your Obligations

  1. You reside in a jurisdiction or a territory where online gambling is legal.
  2. You are 18, or the legal age at which gambling or gaming activities are allowed under the law or jurisdiction that applies to you. We reserve the right to request age-proof documents from you anytime.
  3. To access our services, you should not use a VPN, proxy, or similar softwares that mask or manipulate your real location.
  4. You confirm that you are the rightful and authorized holder of the payment method you use.
  5. You must not attempt to reverse any payment or take any action that could result in a payment being reversed by a third party.
  6. When placing bets, you acknowledge that you may lose some or all of the funds you have deposited into your FOMO7 wallet, and you must accept full responsibility for any such losses.
  7. When placing bets, you must not use any information acquired in violation of the laws applicable in the country where you were located at the time the bet was placed.
  8. You should act solely on your own behalf, in a personal capacity, and not on behalf of any other party or for commercial purposes.
  9. You must not attempt to manipulate any feature in the platform or in any way that could harm the integrity of our operations.
  10. Neither you nor, where applicable, your employees, employers, agents, or family members, register as Affiliates in our Affiliate program.

4. Restrictions

  1. You’re under 18 (or below the legal gambling age in your country), cannot legally enter into a contract, or are acting for someone underage.
  2. You live in a country where online gambling is prohibited.

  1. You must not collect or use other users’ personal information (such as emails or usernames), spam them, or link to our services without permission.
  2. You cannot interfere with other users or disrupt the normal operation of our services.
  3. You cannot post ads, affiliate links, or any kind of solicitation. These may be removed without prior notice.
  4. You cannot cheat the system, cheat other users, or work with others to gain an unfair advantage.
  5. You cannot scrape odds, copy data, or violate our intellectual property rights.
  6. You cannot use our services for anything unlawful.
  7. You must not sell, transfer, or buy accounts from other users. 
  8. You must not move money between user accounts.
  9. If You use your account for unauthorized purposes, We have the right to close it right away and, if necessary, take legal action.
  10. Employees of the company (and its partners, agencies, contractors, and their immediate families) cannot use services for real money unless they have written permission from the Director or CEO. If found using services illegally, their account will be closed and all winnings/bonuses will be withheld.
  11.  Each user is only allowed one bonus. This limit also applies across families, households, shared devices, shared IPs, and identical account/payment details. Any malpractice with bonuses will result in account closure.

5. Registering

  1. We reserve the right to reject any registration application at our sole discretion without providing a reason.
  2. Before you can avail our service, you must personally complete the registration form and agree to all terms and conditions.
  3. To place bets or withdraw winnings, you might be required to complete a verification process. This includes providing valid proof of identity such as passport, driver’s licence, or national ID card and a recent utility bill showing Your name and address as proof of residence.
  4. We may suspend your betting activity or limit certain features on your account until the requested information is provided. These checks are carried out in line with applicable gaming regulations and anti–money laundering laws. 
  5. You will also need to fund your account using the payment options listed in the payment section of our website and mobile application.
  6. You must provide accurate and up-to-date contact details, including a valid email address and update them whenever necessary. It is Your responsibility to keep this information updated. If you don’t, you may miss important notifications from us. 
  7. We use your registered e-mail address as the main way to identify and communicate with you. You are responsible for maintaining an active, secure, and unique email account, making sure we always have the correct address, and notifying us if it changes. You are also fully responsible for protecting your email from any unauthorized use.
  8. We are not liable for any loss or damage caused by communications sent to your registered email Address. If you don’t provide a reachable email address, your account will be suspended until you do. If you deliberately provide false or inaccurate information, We may suspend your account immediately, or take legal action.
  9. You should only create one account on our platform. If We discover that you have created multiple accounts, they will be closed immediately. This rule also applies if accounts are created or operated by representatives, family members, associates, affiliates, related parties, or any third party acting on your behalf.
  10. To verify your identity and confirm Your financial reliability, We may request additional details from you, such as Your full name, or obtain information from third-party providers We deem appropriate. If we collect any such information from third parties, we will notify you of the data received.
  11. You are responsible for keeping your password confidential. If the correct account details are entered, we will assume that all bets, deposits, and withdrawals were made by you. For added security, we recommend changing your password regularly and never sharing it with anyone. Protecting your password is your responsibility, and failure to do so will be at your own risk and expense.
  12. You should log out after each session. If you believe your account  has been compromised, you must inform us immediately. We would request extra information or documents to confirm your identity. Once notified, we will suspend your account right away, but until then, you are responsible for all activities carried out on your account, including unauthorized access by third parties.
  13. You must not share or transmit any content or information from our website and mobile application to others by screenshots or similar methods, nor display it in any way that differs from how it would normally appear when accessed directly through our website and mobile application.
  14. When registering, you can choose from the currencies available on the website and mobile application. Your deposits, withdrawals, and bets will be processed in the selected currency as outlined in terms and conditions.
  15. We are not obligated to open an account for you. The sign-up page on our website is only an invitation to apply. To or not to open an account is solely at our discretion, and if we refuse your registration, we reserve the right not to specify a reason.
  16. After receiving your application, we may contact you to request additional information or documents in order to comply with our legal and regulatory obligations.

6. Your FOMO7 Account

  1. We may suspend or close your account if you fail, or we believe you are failing, to comply with these Terms, to protect the fairness and integrity of the Service, or for other valid reasons. In some cases, we won’t give prior notice. If suspension or closure is due to a breach of our terms and conditions, we may void your bets and withhold funds in your account, including deposits.
  2. We reserve the right to suspend or shut down your account permanently without providing prior notice and return the remaining balance to your bank account. However, obligations that have already been confirmed will still be honoured.
  3. If your account becomes overdrawn, you will owe us the overdrawn amount.
  4. You must notify us immediately if you notice any errors with your account.
  5. Betting is for entertainment only.If you feel an addiction, you may request self-exclusion by emailing Customer Support from your registered email. The request will take effect within 24 hours, and your account will be disabled until you request otherwise.
  6. You cannot transfer, sell, or pledge your account or any of its assets (such as deposits, bets, winnings, or rights) to another person or entity, in any form or by any means. If found of such practices, your account will be suspended until further notice.
  7. To close your account, you must email Customer Support from your registered email address.
  8. If winnings from a single bet exceed the limit set by us, the platform reserves the right to void those winnings.
  9. If your daily winnings exceed the limit set by us, we reserve the right to void the excess winnings.

 

7. Inactivity

  1. If your FOMO7 account has a positive balance but is inactive for a year, we will charge you a month inactivity fee.
  2. You will be notified that an inactive fee will soon apply a month before it is being deducted.
  3. The inactivity fee will be deducted monthly as long as your account has funds and remains inactive beyond the twelve-month period. If your FOMO7 account balance is less than the minimum balance, only the remaining balance will be taken as the fee.

8. Depositing

  1. All deposits must come from an account, payment method, or credit card registered in your own name. Deposits made in a different currency will be converted using the daily exchange rate from our bank’s/payment processor’s exchange rate, and then credited to your account. Please note, some payment providers may charge additional currency conversion fees, which will be deducted from your deposit.
  2. Certain fees and charges may apply to deposits and withdrawals, details of which are available on our website and mobile application. In most cases, we cover the transaction fees for deposits to your account. However, you are responsible for any charges applied by your own bank when depositing.
  3. We are not a financial institution and rely on third-party electronic payment processors to handle credit and debit card deposits. Funds will only be credited to your account if your card issuer provides an approval and authorization code. If no authorization is received, the funds will not be credited.
  4. You agree to pay all charges owed to us or our payment providers for using our service. You must not request chargebacks, cancellations, or reversals of deposits. If you do, you will be required to repay us the full amount plus any related costs, and any winnings earned from such reversed funds will be forfeited. You also acknowledge that your account is not a bank account—it is not insured, guaranteed, or protected by any deposit or banking insurance scheme, nor does it earn any interest.
  5. By entering a bonus code during a deposit, you agree to the general bonus terms and the conditions of each specific offer.
  6. You must not deposit funds that come from criminal, illegal, or unauthorized activities.
  7. If you use a credit card to deposit, it is advised that you keep a copy of your transaction records.
  8. Online gambling may be illegal in your territory. If it is, you are not permitted to make any payments on our platform. It is solely your responsibility to understand and comply with the gambling laws of your country of residence.

9. Withdrawal

  1. You can withdraw any cleared, unused funds in your user account by submitting a withdrawal request under our withdrawal rules.
  2. Before approving any withdrawal, we may request photo ID, proof of address, or additional verification such as a selfie or verification call to confirm your identity. We may carry out such checks at any time.
  3. Withdrawals must be made to the same debit/credit card, bank account, or payment method originally used to fund your account. At our discretion, we may allow withdrawals to another payment method, but only after extra security checks.
  4. If you want to withdraw funds but your account is inaccessible, dormant, locked, or closed, you must contact our Customer Support team.
  5. Withdrawals or refunds cannot be guaranteed if you breach the restricted use policy in clauses 3 and 4.

10. Transactions

  1. You are solely responsible for paying any amounts owed to us. All payments must be made in good faith, without attempting to reverse or cancel them through a third party to avoid legitimate liabilities. If you initiate a chargeback, denial, or payment reversal, you must reimburse us for the amount plus any losses we incur as a result. Additionally, we may charge an administration fee of INR 5,000 for each such case.
  2. We may process your payments through third-party electronic payment providers or merchant banks. By using them you agree to comply with their terms and conditions, provided these are disclosed to you and do not conflict with our terms and conditions.
  3. All transactions made on our platform may be reviewed to prevent money laundering and terrorist financing. Any suspicious activity on our platform will be reported to the appropriate authorities.

11. Errors

  1. If our system or processes experience an error or malfunction, all affected bets will be void. We are not responsible for any losses, expenses, or claims caused by communication errors, system bugs, or viruses, even if they result in incorrect payments. We reserve the right to void the affected games or bets and take corrective action.
  2. While we take care to avoid mistakes in posting betting odds, if due to human or system error a wager is accepted at odds that are either: (a) significantly different from those available in the wider market at the time of placing the bet, or (b) clearly wrong given the actual likelihood of the event occurring, we reserve the right to void or cancel that wager, including wagers placed after an event has started.
  3. We may reclaim any overpayments made to you and adjust your account to correct mistakes, such as incorrect odds or wrongly entered results.

12. Rules

  1. Results are final after 72 hours. Within that timeframe, corrections will only be made for human error, system issues, or mistakes by the official results source. After 72 hours, no disputes will be accepted.
  2. If a governing body overturns a result within the payout period, all wagers on that event will be refunded.
  3. In games where a “draw” option is offered, bets on a win or loss will lose if the match ends in a draw. If there was no draw option, bet(s) will be refunded in the case of a draw. In case a draw option is provided but it goes to extra time, then extra time will count.
  4. If we cannot verify a result (for example, due to an interrupted broadcast with no alternative source), we may declare wagers on that event invalid and refund stakes.
  5. Minimum and maximum bet limits are set by us and may change at any time without prior notice. We may also apply different limits to individual accounts.
  6. You are fully responsible for your account transactions. Once placed, wagers cannot be changed. We accept no responsibility for missing or duplicate bets. You should review your “My Account” section after each session to confirm all wagers are recorded correctly.
  7. Start times displayed for eSports matches are only indicative and may not be accurate. Bets will be void and refunded if a match is suspended or postponed and doesn’t start within 72 hours of its scheduled start time. Exceptions apply for wagers on tournament progression or outright winners, which will remain valid.

13. Communications and Notices

  1. Any communications or notices you need to send to us must be submitted through the Customer Support form available on the website and mobile application.
  2. Any communications or notices we send to you under terms and conditions will, unless otherwise stated, either be posted on the website and mobile application or sent to your registered email address.
  3. All communications, whether from you or from us, must be in writing, in English, and sent to/from the registered email address.
  4. We may occasionally contact you via email with information about betting, special promotions, and other updates. You can stay out of promotional emails by contacting Customer Support.

14. Force Majeure

We are not responsible for any failure or delay in providing the service caused by things beyond our reasonable control, even where we have taken preventive measures. Such events include, but are not limited to, natural disasters, labour or trade disputes, power outages, government actions or omissions, disruptions to telecommunications, or delays and failures caused by third parties. FOMO7 cannot be held liable for any losses you may suffer as a result. In such circumstances, we reserve the right to suspend or cancel the service without liability.

15. Liability

  1. To the extent permitted by law, we are not responsible for any foreseeable loss or damage (direct or indirect) you may suffer if we fail to meet our obligations under these terms and conditions, unless such liability arises from a legal duty we cannot exclude (such as causing death or personal injury through negligence). Even then, we will not be liable if the failure is due to: (i) your own actions or fault; (ii) issues caused by unrelated third parties (e.g., network performance, congestion, connectivity problems, or your computer equipment); or (iii) events beyond our or our suppliers’ reasonable control, even if precautions were taken. As this service is intended solely for consumer use, we are not liable for any type of business-related losses.

  2. If we are found liable under these Terms, our maximum total liability to you will not exceed the lesser of: (a) the value of the bets or wagers placed on your account relating to the matter in question, or (b) €500 in total.

  3. We strongly advise that you (i) ensure the Service is compatible with your computer equipment before use, and (ii) take reasonable security measures to protect yourself against harmful software or devices, including using antivirus programs.

16. Under-age Gambiling

  1. If we suspect, or are notified, that you are under 18 years of age (or below the legal age in your jurisdiction) or were under that age when you placed bets on our platform, we will suspend your account to prevent further betting or withdrawals while we investigate. This includes checking whether you may have been betting on behalf of someone underage. If it is confirmed that you: (a) are currently underage; (b) were underage at the time of betting; or (c) have been betting as an agent for an underage person:
    • Winnings, if any, in your account will be withheld
    • Any winnings earned while underage must be repaid to us on request (and if you do not comply, we will recover the costs)
    • Any deposits in your account that are not winnings will either be returned to you or, at our discretion, held until you reach the age of 18. We also reserve the right to deduct payment transaction fees from any amounts returned, including fees we previously absorbed when you deposited into your account.
  1. This rule also applies if you are over 18 and placing bets from a jurisdiction where the legal minimum betting age is higher, and you are under that jurisdiction’s minimum age.
  2. If we suspect you are breaching this clause, or attempting to misuse it for fraudulent purposes, we reserve the right to take any necessary action, including reporting the matter to law enforcement authorities.

17. Fraudulent Activities

We reserve the right to pursue criminal proceedings and contractual remedies against any user found to be engaged in fraudulent, dishonest, or criminal activities. Where such conduct is suspected, we will withhold all payments to the user. The user agrees to indemnify us and shall be responsible for reimbursing, upon demand, any costs, expenses, or losses suffered or incurred by us (including direct, indirect, or consequential losses, as well as loss of profit, business, or reputation) that result, directly or indirectly, from the user’s fraudulent, dishonest, or criminal actions.

18. Intellectual Property

  1. Any unauthorized use of our name or logo may lead to legal proceedings against you.
  2. All rights to FOMO7, including its technology, software, business systems, and betting odds, belong solely to us. You are not permitted to use your personal profile for commercial purposes (for example, selling updates to advertisers). Additionally, we reserve the right to remove offensive or insensitive usernames.
  3. You are prohibited from using our website address, trademarks, trade names, trade dress, logos, or betting odds in connection with any product or service that is not ours.
  4. Unless explicitly stated in these terms and conditions, neither we nor our licensors grant you any rights, licenses, titles, or interests of FOMO7. All such rights remain exclusively with us and our licensors. You must not use automated or manual tools to monitor or copy pages or content from our website or mobile application. 

19. Your Rights

  1. As long as you comply with these terms and conditions, we grant you a limited, non-exclusive, non-transferable, and non-sub-licensable license to access and use the service solely for personal, non-commercial purposes. This license automatically ends if our agreement with you under these terms and conditions is terminated.
  2. Except for your own content, you are not permitted to modify, publish, transmit, transfer, sell, reproduce, upload, post, distribute, perform, display, create derivative works from, or otherwise exploit FOMO7, its content, or its software in any way, unless expressly allowed by these terms and conditions or otherwise stated on the website or mobile application. You also cannot change, merge, republish, or use FOMO7’s information or content in any way — including activities like screen scraping, database scraping, or reorganizing the data.
  3. Failure to comply with this clause may infringe our intellectual property rights or those of third parties, and could expose you to civil liability and/or criminal prosecution.

20. Your Conduct and Safety

  1. To protect both you and other users, it is strictly prohibited to post any content on FOMO7, or to engage in any conduct related to FOMO7, that is unlawful, inappropriate, or otherwise unacceptable.
  2. List of prohibited behaviour on FOMO7:
    • Conduct or support unlawful or criminal activities, including violating another person’s privacy or rights, or spreading harmful software or viruses.
    • Exploit or harm minors in any way.
    • Transmit or share content that is unlawful, harmful, threatening, abusive, defamatory, obscene, vulgar, hateful, violent, or otherwise offensive (including racially or ethnically objectionable material).
    • Share content you are not legally authorized to distribute, including material that infringes intellectual property rights such as copyrights or trademarks.
    • Upload, share, or spread viruses, malicious code, or any software designed to damage, alter, or disrupt FOMO7, its presentation, or other systems.
    • Interfere with or disrupt FOMO7 in any way, including reverse-engineering, using cheats, hacks, or unauthorized software to manipulate the platform.
    • Use bots, spiders, or other automated tools to collect or index information from FOMO7.
    • Participate in fraudulent or deceptive activities, including actions that scam or mislead other users.
    • Send spam or similar unauthorized messages on game chat.
    • Create accounts using automated systems, false information, or fraudulent identities.
    • Impersonate another user, third party, or any person in general.
    • Engage in any other activity that we, in our discretion, deem contrary to our business principles.

This list is updated constantly. We reserve the right to investigate and take any action we consider necessary, including deleting content, suspending or closing accounts, and pursuing action against anyone directly or indirectly involved in such behaviour, with or without notice.

21. Third-party Links

FOMO7 website or mobile application may include links to third-party websites that we do not own, operate, or control. These links are provided only for your convenience, and we do not review, monitor, or verify their accuracy or completeness. The presence of such links does not mean we endorse or are affiliated with those websites, their content, or their owners. When visiting such websites, you should take standard precautions, including reviewing their privacy policies and terms of use.

22. Complaints

  1. If you have any questions or concerns about these terms and conditions, please contact our Customer Support team using the links provided on the Website and mobile application. You must use your registered email address for all communications with us.
  2. If you are unhappy with the settlement of a bet, you should search out to the Customer Support team with all details. We will make reasonable efforts to respond within a few days and, in any case, within 28 days of receiving your complaint.
  3. Any dispute must be submitted within three days of the decision on the wager in question. Claims submitted after this period will not be considered. You are solely responsible for managing your account transactions.
  4. If a dispute arises between you and us, our Customer Support team will try to resolve it amicably. If no resolution is reached, the issue will be escalated to our management team.
  5. If all attempts to resolve the dispute remain unsuccessful, you may escalate your complaint to our licensing authority, Gaming Services Provider N.V.

23. Assignment

You may not transfer or assign these terms and conditions, or any of your rights or obligations under them, without first obtaining our prior written consent, which will not be unreasonably refused. We, however, may assign or transfer all or part of our rights and obligations under these terms and conditions to a third party without your consent, provided that the third party can deliver a service of substantially the same quality as ours. In such cases, we will provide notice of the assignment by posting it on the website and mobile application.

24. Severability

If any part of these Terms is found by a competent authority to be invalid or unenforceable, that specific provision will be adjusted so that it can be enforced in a way that best reflects the original intent, to the maximum extent allowed by law. The rest of the terms and conditions will remain valid and enforceable.

25. Breach of Terms & Conditions

If we believe you have violated any significant terms of these terms and conditions, we may suspend or close your account and stop providing the service to you without prior notice. However, we will inform you promptly after such action has been taken. 

26. General Provisions

  1. Terms of agreement: These Terms remain valid as long as you access or use FOMO7, or are a user or visitor of the Website. They continue to apply even after your account is terminated for any reason.
  2. Gender: Words in the singular include the plural and vice versa. Words in the masculine gender also include the feminine and neutral, and vice versa. References to “persons” include individuals, partnerships, associations, trusts, unincorporated organisations, and corporations.
  3. Waiver: If we waive a breach or potential breach of these terms and conditions, it will only be effective if made in writing and signed by us. Such a waiver applies only to the specific situation mentioned and does not prevent us from enforcing the same or other provisions later. Our failure to enforce any provision at any time does not mean we waive our right to enforce it in the future.
  4. Acknowledgement: By accessing or using FOMO7, you confirm that you have read, understood, and agreed to all parts of these Terms. You also waive any future argument, claim, or proceeding that contradicts what is stated here.
  5. Language: If there is any inconsistency between the English version of these Terms and a translation in another language, the English version shall prevail.
  6. Governing Law: These terms and conditions are governed solely by the applicable law in force.
  7. Agreement: These Terms and conditions represent the complete and final agreement between you and us regarding your use of FOMO7, and replace all prior written or oral agreements on this subject.
  8. Transfer Restrictions: You cannot transfer, sell, or pledge your account to anyone else. This includes transferring or assigning any assets tied to your account (such as balances, winnings, deposits, bets, or related rights and claims). This prohibition covers all forms of transfer, including pledging, trading, brokering, gifting, or assigning to any individual, company, foundation, association, or third party.
